1. Agreement to Terms

By accessing or using services provided by KalnyesGrowth ("we," "our," "us"), you agree to be bound by these Terms of Service. KalnyesGrowth is operated by Jose Jessyt Morales Ricaldi, based in Stafford, Virginia. If you do not agree to these terms, do not use our services.

2. Services We Provide

KalnyesGrowth provides the following services to local businesses:

Custom Website Design: We design, build, and host custom websites tailored to your business and market.
AI Agent Systems: We deploy AI-powered automation tools including Voice Receptionist, Missed-Call Text Back, Reviews Automation, Webchat, Unified Messaging, CRM, Payments, Appointment Reminders, Social Media Manager, Email and SMS Campaigns, Online Booking, and Customer Reactivation agents.
Managed Hosting: Ongoing website hosting, maintenance, and support.

3. Messaging Consent

By providing your phone number to KalnyesGrowth or interacting with our AI systems, you consent to receive text messages (SMS/MMS) related to our services. This includes:

Appointment confirmations and reminders
Service-related notifications
Follow-up messages regarding your inquiry
AI-generated responses from our automation systems

Message and data rates may apply. Message frequency varies based on your interactions. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Consent to receive messages is not a condition of purchasing any service.

4. AI-Powered Communications

Our services use artificial intelligence to handle phone calls, text messages, and chat interactions on behalf of your business. By using our AI agent services, you acknowledge that:

AI agents will interact with your customers using your business name and information
AI-generated responses aim to be accurate but may occasionally contain errors
You are responsible for reviewing and configuring the information your AI agents use
Call recordings and transcripts may be stored for quality assurance and service improvement

5. Payment Terms

All services are billed as agreed upon in your service contract. Recurring services (hosting, AI agents) are billed monthly. Payments are processed securely through Stripe. By subscribing to a recurring plan, you authorize us to charge your payment method each billing cycle until you cancel.

Refunds are handled on a case-by-case basis. If you cancel a recurring service, your access continues through the end of the current billing period.

6. Client Responsibilities

As a client, you agree to:

Provide accurate business information for your website and AI agents
Not use our services for any unlawful purpose
Not send spam, unsolicited messages, or misleading communications through our systems
Comply with all applicable local, state, and federal laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
Maintain valid consent from your customers before using automated messaging features

7. Intellectual Property

Upon full payment, you own the website content and design we create for your business. You may transfer your website to another provider at any time. We retain the right to showcase your project in our portfolio unless you request otherwise in writing.

AI agent configurations, proprietary automation workflows, and underlying technology remain the property of KalnyesGrowth. You receive a license to use these systems for the duration of your subscription.

8. Data Handling

We collect and process data as described in our Privacy Policy. This includes business data you provide, customer interaction data processed through our AI systems, and website analytics. We implement industry-standard security measures to protect all data.

9. Service Availability

We aim for maximum uptime but do not guarantee uninterrupted service. AI agents, websites, and automation systems may experience occasional downtime for maintenance or due to factors beyond our control. We will notify you of planned maintenance when possible.

10. Limitation of Liability

KalnyesGrowth is not liable for any indirect, incidental, or consequential damages arising from the use of our services. This includes but is not limited to: lost revenue from AI agent errors, missed calls or messages during downtime, or inaccuracies in AI-generated content. Our total liability is limited to the amount you paid for services in the preceding 12 months.

11. Termination

Either party may terminate services with 30 days written notice. Upon termination:

You retain ownership of your website files and content
We will assist in transferring your website to another provider upon request
Access to AI agent systems will be deactivated at the end of the billing period
Stored data will be retained for 90 days, after which it will be permanently deleted unless you request it sooner

12. Modifications to Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the updated terms. For material changes, we will notify you via email or through your client dashboard.

13. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia. Any disputes will be resolved in the courts of Stafford County, Virginia.
